These Terms of Use (“Terms”) govern your access to and use of GoodLoan.ca, the GoodLoan borrower portal, and related online services provided by GoodLoan (“GoodLoan,” “we,” “us,” or “our”).
By accessing or using GoodLoan.ca, you agree to these Terms.
These Terms govern use of the website and portal. They are not a substitute for a loan agreement. If you receive and accept a loan from GoodLoan, the applicable loan agreement, cost-of-borrowing disclosure, payment authorization, and other loan-specific documents will govern the loan.
1. About GoodLoan
GoodLoan provides an online platform through which eligible individuals may submit information and apply for lending products offered or arranged by GoodLoan where available.
Availability, eligibility, loan amount, term, pricing, and other conditions may vary by borrower, product, and jurisdiction.
Nothing on this website constitutes a guarantee that you will be approved for a loan.
2. Eligibility
You may use GoodLoan’s lending services only if you satisfy the eligibility and legal-capacity requirements applicable to the product and jurisdiction.
GoodLoan may consider applicants who meet applicable requirements and who fall within supported residency categories, which may include Canadian citizens, permanent residents, open work permit holders, and study permit holders.
Additional eligibility requirements may apply.
Temporary-resident eligibility may depend on factors including permit validity and requested loan term.
3. Account Registration
Certain GoodLoan services require an account.
You agree to provide accurate and complete registration information, maintain the accuracy of your information, protect your password and authentication credentials, and promptly notify GoodLoan if you believe your account has been compromised.
You may not create an account using another person’s identity without authorization.
GoodLoan may suspend, restrict, or disable access where we reasonably believe an account is compromised, being misused, or being used contrary to these Terms or applicable law.
4. Loan Applications
Submitting an application does not guarantee approval.
GoodLoan may require information concerning your identity, address, employment, income, financial circumstances, requested loan amount, loan purpose, existing obligations, and other factors relevant to the application.
GoodLoan may also require supporting documentation or third-party verification.
You agree that information submitted in an application will be truthful, accurate, complete, and not misleading.
Providing false, altered, fraudulent, or materially misleading information may result in application cancellation or other action permitted by law.
5. Requested Amounts and Terms
GoodLoan may allow borrowers to request a loan amount, term, and payment frequency.
A requested amount or term is not an approval.
The amount, rate, APR, payment schedule, repayment frequency, maturity date, and other final loan terms will be established only if GoodLoan approves the application and provides the applicable agreement and disclosures.
6. Rates, APR and Cost of Borrowing
Any general rates, examples, calculators, payment estimates, or illustrations displayed on GoodLoan.ca are informational unless expressly incorporated into a final written loan agreement.
Your actual interest rate, APR, total cost of borrowing, scheduled payments, and other applicable charges will be disclosed before you enter into a loan agreement.
GoodLoan may decline or modify proposed pricing where necessary to comply with applicable legal, regulatory, product, or internal requirements.
7. Identity Verification
GoodLoan may require identity and fraud verification before an application can proceed.
GoodLoan currently uses Didit for verification processes that may include ID verification, proof of address, device analysis, liveness, face matching, and AML screening.
You may be asked to complete verification through a browser or a verification link sent to your verified email address.
For the smoothest experience, GoodLoan may recommend completing identity verification on a mobile phone.
Successful verification does not guarantee loan approval.
8. Supporting Documents
GoodLoan may request documents to support your application.
Requested documents may include identification, proof of address, paystubs, bank statements, and other supporting information.
You agree not to upload malicious software, corrupted files, illegal content, documents belonging to another person without authorization, or altered or fraudulent documents.
GoodLoan may reject files that do not meet technical, security, verification, or application requirements.
9. Credit and Other Verification
Where applicable, GoodLoan may request authorization to obtain credit information or to perform a credit inquiry.
GoodLoan may also use third-party services to verify employment, income, banking, financial information, identity, fraud indicators, or other application information.
Any additional consent required for such services will be obtained or presented as appropriate.
10. Electronic Communications and Signatures
By using GoodLoan’s online services, you agree that GoodLoan may provide applicable communications electronically, subject to any consent or legal requirements that apply.
Electronic communications may include application updates, document requests, verification requests, agreements, disclosures, notices, payment information, and servicing communications.
Where electronic signatures are used, you agree that an electronic signature may have the same legal effect as a handwritten signature where permitted by law.
11. No Guarantee of Approval or Funding
GoodLoan does not guarantee that an application will be approved or funded.
An application may require identity verification, document review, underwriting, compliance review, additional information, execution of agreements, and satisfaction of other conditions before funding.
A preliminary message, estimate, prequalification, or application status should not be interpreted as a commitment to lend unless GoodLoan expressly provides a binding agreement.
12. Third-Party Services
GoodLoan uses third-party providers to operate portions of its services.
These may include identity-verification, hosting, authentication, database, document-storage, communication, financial-verification, credit, payment-processing, electronic-signature, and other providers.
Certain third-party services may be governed by their own terms and privacy notices.
GoodLoan is not responsible for third-party websites or services outside our control, except to the extent required by applicable law.
13. Acceptable Use
You must not use GoodLoan.ca or the borrower portal to impersonate another person; submit fraudulent information; attempt unauthorized access to another user’s account or records; interfere with website security; reverse-engineer or exploit the service except where expressly permitted by law; introduce malware or harmful code; scrape or automatically harvest personal information; circumvent authentication, verification, rate limits, or security controls; manipulate applications, documents, verification results, or payment information; or use the service for unlawful, abusive, deceptive, or fraudulent purposes.
GoodLoan may restrict access where we reasonably believe these Terms have been violated.
14. Submitted Application Records
Before submitting an application, you should review your information carefully.
GoodLoan may preserve a snapshot of information as it existed when the application was submitted.
After submission, certain fields may no longer be directly editable because GoodLoan may need to preserve the original application record for underwriting, compliance, security, dispute-resolution, or audit purposes.
If information needs correction, contact GoodLoan.
15. Loan Agreements Control
If GoodLoan approves a loan and you accept it, your loan will be governed by the final signed loan agreement and applicable disclosures.
If these website Terms conflict with a loan-specific agreement regarding the loan itself, the loan-specific agreement will govern to the extent of the conflict.
16. Payments, Fees and Prepayment
Payment schedules, payment methods, prepayment rights, returned-payment treatment, fees, and other repayment terms will be stated in the applicable loan agreement and disclosures.
Information provided generally on GoodLoan.ca does not override the terms of an executed loan agreement.
GoodLoan will not impose a charge merely because it is described on a website if the applicable agreement or law does not permit that charge.
17. Missed Payments and Collections
If you have difficulty making a scheduled payment, you should contact GoodLoan as early as possible.
GoodLoan may contact borrowers regarding missed, returned, or overdue payments and may take servicing or collection steps permitted by the applicable agreement and law.
Nothing in these Terms creates an automatic right to defer, extend, refinance, or modify a loan.
18. Loan Extensions or Modifications
GoodLoan may consider an extension, modification, or other arrangement in certain circumstances.
Any such arrangement is subject to approval and may require a new or amended agreement.
A borrower should not assume that contacting GoodLoan automatically changes an existing payment obligation.
19. Intellectual Property
GoodLoan.ca, including its design, text, graphics, software, branding, logos, and other content, is owned by or licensed to GoodLoan unless otherwise indicated.
You may use the website for personal, lawful purposes related to obtaining information about or using GoodLoan’s services.
You may not copy, reproduce, distribute, commercially exploit, or misrepresent GoodLoan content except as permitted by law or with written authorization.
20. Website Availability
We aim to keep GoodLoan.ca available and functioning securely, but we do not guarantee uninterrupted or error-free availability.
The service may occasionally be unavailable because of maintenance, updates, network failures, provider outages, security events, or circumstances beyond our reasonable control.
Third-party service failures do not by themselves constitute a loan approval or rejection.
21. Information on the Website
We make reasonable efforts to keep information accurate and current.
However, website information may not reflect every product, jurisdiction, borrower circumstance, or subsequent change.
Loan-specific disclosures and agreements provided to you should be reviewed carefully before you accept a loan.
22. Disclaimer
To the maximum extent permitted by applicable law, GoodLoan.ca and its general website content are provided on an “as available” basis.
Nothing on the website constitutes legal, tax, investment, accounting, or financial-planning advice.
Nothing in these Terms excludes warranties, rights, remedies, or protections that cannot legally be excluded under applicable consumer-protection or other law.
23. Limitation of Liability
To the maximum extent permitted by applicable law, GoodLoan will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of or inability to access the general website.
This limitation does not apply where liability cannot legally be excluded or limited.
Nothing in these Terms limits GoodLoan’s obligations under an applicable loan agreement or mandatory consumer-protection law.
24. Indemnity
To the extent permitted by law, you agree to be responsible for losses, claims, or costs resulting from your fraudulent, unlawful, or unauthorized use of GoodLoan.ca or a material violation of these Terms.
This provision does not require you to indemnify GoodLoan for GoodLoan’s own unlawful conduct.
25. Privacy
Your use of GoodLoan.ca is also subject to our Privacy Policy.
The Privacy Policy explains how GoodLoan collects, uses, discloses, secures, and retains personal information.
26. Suspension and Termination
GoodLoan may suspend or terminate access to the website or borrower portal where reasonably necessary for security, fraud prevention, legal compliance, account protection, or enforcement of these Terms.
Suspension of portal access does not by itself cancel or eliminate obligations under an existing loan agreement.
27. Governing Law
These Terms are governed by the laws applicable in Canada and the applicable province or territory, subject to mandatory consumer-protection and jurisdictional rights that cannot legally be waived.
28. Changes to These Terms
We may modify these Terms from time to time.
The updated version will be posted on GoodLoan.ca with a revised “Last updated” date.
Where required, we will provide additional notice or obtain consent before a material change applies.
